Introduction
In the course of my research into the connections between my great-grandfather, Hamilton Police Chief Thomas Brown, and notorious prohibition-era mobster, Rocco Perri, I discovered that the head of the Royal Commission who investigated Rocco Perri in 1926 was Chief Justice James Thomas Brown.
Chief Justice James Thomas Brown
Chief Justice James Thomas Brown headed the Royal Commission on customs and excise, 17 Nov 1926, investigating customs corruption in cross-border alcohol smuggling, involving Rocco Perri and Thomas Hatch. He was a lawyer, judge and political figure in Saskatchewan. He represented Souris in the Legislative Assembly of Saskatchewan from 1905 to 1908 as a Provincial Rights Party member. Portadown, Armagh, Ireland
Chief Justice Brown’s family originally came from Portadown, Armagh, Ireland — the same place as my ancestors. Notwithstanding the fact that Brown is the 3rd most common surname in the English language, the coincidence of the same surname and same place of origin for both families connected in this story was too enticing for me not to investigate the possibility that Chief Justice Brown and Police Chief Brown might be related. Chief Justice Brown’s family tree is presented below. Police Chief Tom Brown’s family tree is presented on the Brown Family in Hamilton page.
While both of our Brown families originate within walking distance of each other in Armagh, Ireland, disappointingly, no direct connection has been found between the two families.
DNA Evidence
In 2022, a descendant of Chief Justice Brown took a Y-DNA test which were compared to mine. The test results showed conclusively, that, despite both our Brown families having such close geographic origins, we are not genetically related in the male line.

In 1851, Robert was residing in Elgin, Beauharnois, Quebec, Canada, as a labourer and a Methodist. He has not been found in later census records. He could easily have moved away and it would be impossible to identify him in census searches as there were a billion Robert Browns born about 1826 in Ireland living in North America. Some of his siblings moved to Manitoba, Saskatchewan, Canada, and Iowa, USA, so he could be anywhere.

“John Brown was born in Ireland on September 13, 1827, a son of John and Martha (Thistle) Brown. They moved to Canada when John was three years old. At about the age of twenty-eight years he moved to Floyd County, Iowa the year after the county was organized and established his home on a section of land in Riverton township. John Brown was married twice. In 1856, he was united in marriage to Nancy Kerns, who died on the old home place in Riverton township, leaving three children, John, Albert and George Brown. In 1865 Mr. Brown married Eliza Ann Kellogg, daughter of John and Rachel (Shelley) Kellogg. “Walter George Brown (September 6, 1875 – April 1, 1940) was a Presbyterian Church in Canada minister who opposed the formation of the United Church of Canada and was a United Reform Movement MP in the Canadian House of Commons.
Born in Athelstan (now Hichinbrooke), Huntingdon County, Quebec of Scots-Irish parents, Brown was educated at McGill University where he received an Honours B.A. Degree in 1899 and at The Presbyterian College, Montreal, where he graduated in 1902 with a B.D. degree, the Silver Medal, a $60.00 Theological Scholarship, and a prize ($10.00 in books) in public speaking. He also won other scholarships and prizes during his time at Presbyterian College. During his summers, he went into the newly opened lumbering camps of Northern Ontario, serving first as a student missionary, was ordained on 30 September 1902 as an Ordained Missionary to Canada Atlantic Lumber Camps, from Rainy Lake to Whitney under the North Bay Presbytery. He remained in this post until July 1903, when he moved west to work amongst miners in the West Kootenay area of British Columbia at Salmo, New Denver and Silverton, all in proximity of Nelson.
While serving in ministry in British Columbia, he earned his M.A. degree from McGill, with a paper titled “History and Philosophy of Socialism”, and was married to Martha Rowat of Athelstan, Quebec; her father, Andrew Rowat (1839-1918) served as minister at Elgin and Athelstan from 1884 – 1909; her mother, Margaret, was the daughter of Donald MacKenzie pioneer minister in Zorra Township, Oxford County, Ontario.
After leaving the Kootenays to study in Montreal and at the United Free Church of Scotland College in Glasgow, he was called and inducted in March 1908, as minister of Knox Presbyterian Church in Red Deer, Alberta, and would remain there until 1925. He also served as convenor of Home Missions for the Red Deer Presbytery supervising three congregations and fifteen missions. He served as Moderator of the Synod of Alberta in 1915.
At the 1925 General Assembly, Brown was one of 79 Commissioners who refused to join the United Church, and met in a corner of Toronto’s College Street United Church at the conclusion on June 9 in order to resume business later that night at nearby Knox Presbyterian Church and legally claim their continuity.
Brown left Red Deer later that year to oversee the re-organization of some Presbyterians in Saskatoon, Saskatchewan that had voted against joining the United Church. St. Andrew’s Presbyterian Church, Saskatoon was formed under his pastoral leadership, and remains the largest PCC congregation within the province.
In June 1931, he was elected Moderator of the Presbyterian General Assembly, and during his Moderatorial year, travelled to Asia, and visited Korea, Japan, Taiwan, and the Manchuria portion of China.
Reverend Walter George Brown is one of the few Moderators of the Presbyterian Church who was or is not a Reverend Doctor; he refused to accept Honorary Doctorates from his Alma Mater, nor Toronto’s Knox College. His funeral took place in Ottawa, and is buried at the Athelstan Presbyterian Cemetery.”

Elizabeth is not recorded in other family histories and her sister Sarah’s later biography refers to Sarah as “the youngest daughter of John Brown and Margaret Thistle” which suggests that Elizabeth likely died young.

John Brown and his family left Ireland in 1831 and immigrated to Huntingdon, Quebec, Canada.
Huntingdon is a small town in Huntingdon County in the Haut-Saint-Laurent Regional County Municipality and the Montérégie region of the province of Quebec, Canada. The town is 75 km southwest of Montreal, and 15 km from the border with New York State.
The town was settled by British soldiers after the War of 1812 and the fertile land in the area led to a successful farming economy. Once the fear of attack from the Americans was gone, in the 1820s businessmen established lumber and grist mills on the banks of the Chateauguay River. (Wikipedia)

Samuel’s son, Chief Justice James Thomas Brown, did an informal family history in the 40’s and his first page reads:
“The forebears of the Browns at Huntingdon, Quebec, on father’s side, came originally from the County of Armagh, Northern Ireland, and more specifically from the town of Killylea. This town is located on the south-west side of Lake Kircubbin. It’s not far from Belfast and directly across the North Channel from Scotland. My father was born there in 1829.”

Chief Justice James Thomas Brown headed the Royal Commission on customs and excise, 17 Nov 1926, investigating customs corruption in cross-border alcohol smuggling, involving Rocco Perri and Thomas Hatch.
He was a lawyer, judge and political figure in Saskatchewan. He represented Souris in the Legislative Assembly of Saskatchewan from 1905 to 1908 as a Provincial Rights Party member.
He was born in Huntingdon, Quebec, the son of Samuel Brown and Margaret White, and was educated there and at McGill University. Brown moved to Manitoba in 1833 and to Saskatchewan in 1896. He practised law in Moosomin, Saskatchewan and later served as Crown Prosecutor for Assiniboia district.
In 1891, James was residing in Hitchingbrooke, Quebec, Canada with his parents and siblings. He was a law student.
In 1922, he married Alice M. Lewis. Brown was an unsuccessful candidate for a seat in the House of Commons in 1908.
He later lived in Regina. Brown served as a puisne judge for the Supreme Court of Saskatchewan. He was named Chief Justice for the Saskatchewan Court of King’s Bench in 1918.
Brown died in Regina, Saskatchewan, Canada, on April 28, 1957, at the age of 86.
Brown – Sunday, April 28th, Chief Justice Hon. James Thomas Brown, dearly beloved husband of Mrs. Laura Brown, 2159 Scarth St., passed away at the age of 86 years. Funeral services will be held on Wendesday, May 1st at Knox-Metropolitan church at 3 p.m. Rev. H. A. Mutchmore and Rev. A. H. E. Barger will officiate and burial will be in the family plot, Regina cemetery. Besides his wife Chief Justice Brown is survived by four sons, Dr. J. L. Brown, 69 Leopold Crescent; Allan L., and Wilfred G., of Ottawa; and Leonard R., Toronto; and one daughter, Winnifred, of Huntingdon, Que.; also nine grandchildren and one sister, Mrs. E. C. McCoy and one brother, Frank R., both of Huntingdon. Arrangements in care of Speers Funeral Home.

James T. Brown was born in Huntington, Quebec in 1871. He graduated with honours from McGill University in 1893. He was admitted to the Manitoba Bar in 1896 and then moved to Moosomin (one of the most active judicial centres in the Province at that time) to establish the well-known, successful firm of Brown, Wylie and Mundell.
In 1910 he was appointed to the Supreme Court of Saskatchewan and in 1918, when the Saskatchewan Courts were reorganized to establish an Appeal Court and a King’s Bench Court, he was appointed the Chief Justice of the Court of King’s Bench where he presided for thirty-nine years.
Justice Brown served on the Regina Riot Inquiry Commission (1935-1936), the Royal Grain Inquiry Commission (1928-1931) and the Brown-Elwood Royal Commission (1916).
Chief Justice Brown died on April 29, 1957.
